If you are an American citizen and your fiancé is a foreign national, you can apply for a K1 Visa to be issued to your fiancé. However, the visa will only be issued to your fiancé if that individual needs to come to USA to get married. Your fiancé does not need the K1 Visa if they are already in the United States. It would more appropriate to apply for a Green Card instead of a K1 Visa if the fiancé is already in the USA. After you get married to your foreign fiancé, you should apply for a Green Card to allow your fiancé to live permanently in the United States. What Are The Requirements For The K1 Visa?

You can only apply for a K1 Visa for your fiancé who is not a USA citizen if you meet the following requirements:

  • Both you and your foreign fiancé must be single. You cannot be issued a K1 Visa if you are already married to someone else
  • The foreign national must be engaged to be married to a US citizen 
  • You and your fiancé must intend to be married in the United States
  • You and your fiancé must have physically met in person at least once in the last two years.  Skype and other online video chats do not count in this situation. There are some exceptions to this.
  • You must intend to get married within 90 days of entry. 
  • The person petitioning for a K1 Visa must be a United States citizen not a Green Card holder. Green card holders are eligible for a CR1 visa
  • The petitioner must meet the minimum income requirements required for the K1 Visa

The K1 Visa Application Process

K1 Visa LawyerThe K1 Visa application process can be completed through 2 steps.  First, your application for a Visa has to be approved by the USCIS, and secondly, the USCIS forwards your approval to the US embassy where your fiancé is located. It is in that US Embassy where your fiancé will be interviewed for the K1 Visa. 

The K1 Visa interview’s purpose is to determine whether your relationship is a sham meant to help you get in the United States fraudulently. You should not feel threatened because of this if you are in a legitimate relationship with your US-Citizen fiancé. In addition, the questions will not be complicated. For example, you will be asked how long you have known your fiancé, what your fiancé does for work and so on.
